Terms and Conditions – Supplies Rewards Australia

Information on how to enter, Points and Rewards form part of these conditions of entry. As a condition of participation, the Participant accepts these conditions and any rules, policies or procedures that may be adopted by the Promoter from time to time. To the extent of any inconsistency, these terms and conditions prevail.
Entry to the HP Supplies Rewards Program (the “Program”) is only open to eligible resellers of HP Genuine Supplies in Australia who purchase the requisite amount of HP Genuine Supplies during the Promotional Period (“Participant”). Employees of the Promoter, its related bodies corporate and its agencies (including, although not limited to resellers) associated with this promotion and those employees' immediate families are ineligible to participate. HP Supplies Channel Health Resellers, HP Managed retail accounts and direct HP Supplies resellers are not eligible to participate in this Promotion.
Program commences at 9.00 am (AEST) on 4 August 2008 and ends at 11.59 pm (AEST) on 1 May 2009. (the “Program Period”). The Promoter may extend this date at its discretion.
To participate in the Program, Participants must first register their full contact details during the Program Period by logging on to www.hp.com.au/suppliesrewards. Participants are limited to one said account and must provide its ABN.
Participants who do not complete their registration process in full will be ineligible to participate.
Eligible purchases means the purchase of any HP genuine ink, toner or paper purchased from Ingram Micro Australia, Synnex, Phoenix Toner, or Tonnex. (“HP Genuine Supplies”).
Points are earned through purchasing the eligible products outlined in clause 6 within the Program Period. The Participant will earn two hundred reward points for each $100 (excluding GST) of Genuine HP Supplies purchased at an HP Authorised Distributor or Sub-distributor for the period from 4 August 2008and 1 May 2009. The Promoter may extend this date at its discretion. Each reward point earned will be credited to the Participant's HP Supplies Rewards account within 30 days of the sales transaction. For the period from 4 August 2008 and 31 August 2008, all valid registrations will receive 400 bonus reward points. Bonus points will be applied to the registrants account within 30 days of eligible registration. Points will accrue for this program from the previous Monday following receipt of acceptance of a partner to the HP Supplies Rewards program.
The Promoter reserves the right to verify the validity of purchases and redemption orders and to disqualify any Participant for tampering with the Program. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Point claims based on purchases of products other than HP Genuine Supplies or sales outside the Program Period are invalid. Any Points not redeemed by May 31 2009 will be forfeited. The Promoter reserves the right to validate all purchases submitted under the Program.
Participants may not pool or combine Points with other Participants in order to redeem a Reward or Rewards of greater value than that Participant would otherwise be entitled.
Points will be credited for purchases of HP Genuine Supplies up to the value of $100,000 per annum (excluding GST) only. No reward points will be available or credited for cumulative purchases over this amount per annum. The per annum period will be measured 365 days from the transaction date of the first purchase after the account has been registered.
To redeem a Reward, Participants must logon to www.hp.com.au/suppliesrewards using their unique login and password, select a product from the Rewards Catalogue and submit it using the checkout. Participants may only redeem Rewards valued at an amount of Points equal to or less than the number of Points the Participant has accrued.
The Promoter will arrange for delivery/distribution of the Reward to Participants and will endeavour to deliver Rewards within 28 working days of submitting the order.
In the event that a specified Reward is not available, the Promoter will at their discretion offer the Participant an alternative Reward of the same value as the original Reward. All Rewards are offered to Participants subject to availability. Under no circumstances can any Reward be exchanged by the Participant in whole or part for cash or kind.
This promotion is not valid in conjunction with any other offer or promotional product bundle.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or suppliers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to Participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this Program.
If for any reason this Program is not capable of running as planned including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness integrity or proper conduct of this Program, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Program.
The Promoter reserves the right to request Participants to provide additional proof of purchases, proof of identity and residency. Identification considered suitable for verification is at the discretion of the Promoter.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, without limitation, indirect or consequential loss), or for personal injury suffered or sustained, as a result of taking any of the Rewards, except for any liability which cannot be excluded by law. It is the responsibility of the Participant to declare this income in their personal income tax return to be taxed accordingly by the Australian Tax Office, and Participant will be solely liable to pay any such taxes or ancillary costs associated with this Program.
HP is not responsible for any Fringe Benefit Tax liabilities arising from the Program. Any Fringe Benefit Tax liabilities must be met by the Participant.
All claim forms become the property of the Promoter. The Promoter's privacy policy may be viewed at: http://welcome.hp.com/country/nz/en/privacy.html. If Participants opt-in (for example, by agreeing in the registration form that HP may contact the Participant), then the Participant consents to the use of all information contained within the registration form for marketing and Program purposes by the Promoter and its affiliates, authorised business partners and suppliers, but the Participant may unsubscribe later if he/she no longer wishes to receive further marketing information.
The Promoter reserves the right to request additional information from Participants, and to use the information contained in the registration form for the purpose of management and administration of the Program.
The Promoter may, in its absolute discretion, change, amend or vary these terms and conditions; withdraw, cancel, vary or change at any time, Points or the value of future Points; cancel the Program in whole in its absolute discretion at any time without prior notice; exclude a Participant from, or cancel a Participant’s registration or participation in, the Program without prior notice to a Participant.
The Promoter’s decision on all matters pertaining to the Program, including but not limited to any dispute as to the identity of a Participant, eligibility to become a Participant or Points accumulated by a Participant is final and binding. No correspondence will be entered into.
